Terms of Service

1. Scope

These terms govern your use of cargoways.io and the freight matching service provided by Franz Xaver Schmidt ("Cargoways", "we"). By submitting a shipment request through this website, you agree to these terms.

2. What Cargoways does

Cargoways is a matching service. We are not a freight carrier, forwarder, or logistics operator. When you submit a shipment request, we forward the relevant details to logistics partners in our network, collect the offers they return, and compile them into a pool for you to review.

Any contract for the actual carriage of goods is formed directly between you and the logistics partner you choose. Cargoways is not a party to that contract and does not itself transport, store, or handle any cargo.

3. Submitting a request

You agree to provide accurate and complete information about your shipment (origin, destination, cargo type, volume or weight, and any other details requested). Inaccurate information may lead to incorrect or delayed offers.

4. Offers from partners

Cargoways does not guarantee that any offers will be received, that offers will meet a particular price or timeline, or that a logistics partner will ultimately accept a given shipment. Offers are made at the discretion of each logistics partner and may change or be withdrawn before you confirm a booking directly with that partner.

5. Fees

We do not currently charge any fees.

6. Intellectual property

The content, design, and branding of cargoways.io are owned by Cargoways or its licensors and may not be copied, reproduced, or distributed without prior written consent.

7. Limitation of liability

Cargoways is a pure intermediary and does not provide logistics services itself. The choice of partner, shipment terms, and all transport decisions are made independently by the user and the logistics partner. Responsibility for transport execution, cargo handling, safety, timing, legality, and any damage to goods lies solely with the respective logistics partner once the shipment is accepted by that partner. To the fullest extent permitted by law, Cargoways assumes no liability for partner performance, cargo loss, damage, delay, or any other claims related to the transport service.

8. Availability

We aim to keep this website available and to respond to shipment requests promptly, but we do not guarantee uninterrupted availability of the website or a specific response time.

9. Governing law and jurisdiction

These terms are governed by the laws of Germany, excluding its conflict of law provisions.

10. Changes to these terms

We may update these terms from time to time. Continued use of cargoways.io after changes are published constitutes acceptance of the updated terms.
